When a personal injury is suffered, it is because of the negligence of another party or parties. The personal injury can be the result of a wide variety of careless actions, including negligence, products liability and workers’ compensation. When trying to recover damages suffered for the personal injury, the monetary damage awards will usually consider lost wages, medical bill and pain and suffering.
The severity of a personal injury can range from minor physical injury to debilitating injuries and death. In some instances, a physical injury may not even be present and the personal injury claimant will seek damages for extreme emotional distress, as well as other psychological impacts. A personal injury claim acts to hold the party or parties accountable for their actions, as well as to best ensure similar events do not continue to occur and injure more victims in the future.
More than half of the states in the United States have so far passed controversial legislation addressing non-economic damages for pain and suffering, as well as other intangibles in personal injury lawsuits and product liability and other civil lawsuits. Some laws have placed a cap on pain and suffering personal injury awards, and though some states have exception for catastrophic cases, many argue the caps are an injustice and only act to further victimize those most seriously suffering from a personal injury.
Elder abuse is only a recently known national problem to many, though evidence suggests elder abuse has existed throughout time on a wide scale. Not too much information is known about elder abuse still, though tackling the deep-rooted problem has become a national and state-to-state priority. The actual incidence of elder abuse is unknown, with the majority of elder abuse cases believed to go unreported.
Abuse can be physical, mental, sexual, financial, as well as complete neglect. Reports of vicious cases of elder abuse have continued to be revealed and lawmakers and officials are trying to reverse trends and create an environment of safety and well-being that is needed now more than ever. The population of persons aged 65 years and older numbered 35.9 million in 2003. Representing 12.3 percent of the U.S. population, about one in every eight Americans are included in the older generation. By 2030, there will be about 71.5 million older persons, which will be more than double the number in 2000, making the urgency to stop elder abuse especially necessary.
